Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and TikCut ("TikCut", "we", "us", or "our") governing your access to and use of the TikCut website, applications, and services (collectively, the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old (16 in the EEA/UK) to use TikCut. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@tikcut.app if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

You retain all ownership rights in the videos, audio, images, and other materials you process with the Service ("User Content"). You grant TikCut a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, and display your User Content solely for the purpose of operating the Service for you. We claim no ownership of your creative output.

You represent and warrant that you have all rights necessary to use your User Content with the Service and that your User Content does not violate any law or third-party right.

You agree not to:

• Use the Service to infringe intellectual property, privacy, publicity, or other rights.
• Upload or process content that is unlawful, defamatory, harassing, sexually exploitative of minors, or that incites violence.
• Attempt to reverse engineer, decompile, scrape at scale, or circumvent security controls.
• Use the Service to build a competing product, or to train machine-learning models without our written consent.
• Resell, sublicense, or share access to your account.
• Interfere with or disrupt the Service or its infrastructure.

Certain features require a paid subscription. Prices, billing cycles, and included features are shown at checkout. By subscribing you authorize us and our payment processors (such as Stripe and Paddle) to charge your selected payment method on a recurring basis until you cancel.

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable. We may change pricing on prospective renewals with reasonable advance notice.

Applicable taxes are added to the price where required. You are responsible for any taxes not collected by us.

We may offer free trials, beta features, or preview programs. These are provided "as-is" and may be changed or discontinued at any time. If a trial converts to a paid plan, the payment method on file will be charged at the end of the trial unless you cancel beforehand.

The Service, including its software, design, trademarks, and content created by us, is owned by TikCut and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. All rights not expressly granted are reserved.

The Service may integrate with third-party services (such as identity providers and payment processors). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk for us or other users, or if we are required to do so by law. Sections that by their nature should survive termination will survive, including ownership, disclaimers, indemnity, and limitations of liability.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR TRADE USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL MEET YOUR REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIKCUT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US DURING THAT PERIOD OR (B) USD $100.

You agree to indemnify, defend, and hold harmless TikCut and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

We may update or modify the Service and these Terms from time to time. Material changes will be announced in-app or by email at least 14 days before they take effect, unless changes are required for legal or security reasons. Your continued use of the Service after changes take effect constitutes acceptance.

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Nothing in this section limits any non-waivable rights you have as a consumer in your country of residence.
